European Communities (Carbon Border Adjustment Mechanism) Regulations 2024

Organisations and customs representatives importing goods covered under Regulation (EU) 2023/956 establishing a carbon border adjustment mechanism (CBAM Regulation) must register and declare imports annually with the Environmental Protection Agency (EPA).
Application for an authorisation
From 31st December 2024, importers established in the State must apply for the status of ‘authorised CBAM declarant’. The application must be submitted through the CBAM registry.
Where an importer is not established in the State, a customs representative must submit the application for an authorisation.
CBAM declaration
Importers with authorised CBAM declarant status must use the CBAM registry each year by 31st May to submit a CBAM declaration for the preceding year, starting in 2027 for 2026 reporting.
Verification
The authorised CBAM declarant must ensure that the information provided in the CBAM declaration is verified by an accredited verifier.
CBAM Certificates
From 1st January 2026, the Environmental Protection Agency will sell CBAM certificates which are worth 1 tonne of carbon dioxide (CO2) equivalent on a common central platform established by the European Commission.Each year, CBAM declarants must surrender the number of CBAM certificates corresponding to the amount of carbon dioxide (CO2) equivalent in their CBAM declaration.
