The REACH etc. Regulations 2020

Amends/Commences:

  1. Regulation (EC) No 1907/2006 concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals (REACH)

  2. The REACH etc. (Amendment etc.) (EU Exit) Regulations 2019 (SI 2019/758)

  3. The REACH etc. (Amendment etc.) (EU Exit) (No. 2) Regulations 2019 (SI 2019/858)

  4. The REACH etc. (Amendment etc.) (EU Exit) (No. 3) Regulations 2019

Comes into force: Depending on the section: 18th December 2020, immediately before IP completion day and IP completion day.
Jurisdiction: Northern Ireland

These Regulations amend REACH and REACH (Amendment)(EU Exit) Regulations passed in 2019. These 2020 Amendments revise the 2019 Amendments to restrict their scope to Great Britain, and to provide arrangements concerning movement of chemicals between Great Britain and Northern Ireland.

Amendments are made due to the introduction of the Northern Ireland Protocol which provide that Northern Ireland will continue to follow EU rules in many respects including REACH. It was previously assumed that Northern Ireland would mirror the regulatory approach in Great Britain following the UK’s exit from the European Union, but since this is not the case, amendments are necessary.
